Canada: Air Passenger Protection Regulations

The Canadian Air Passenger Protection Regulations have come into action in December 2019. The detailed Regulation defines not only passengers’ rights to services but also high compensation sums of up to 2,400 Canadian Dollars.

  1. Compensation Payments
    Compensations must be paid for passengers of delayed and cancelled flights and to those that were denied to board. The Canadian Air Passenger Protection Regulations define varying compensation sums, depending on the scenario. Large airlines (>2 million passengers/year), for example, must always pay the highest sum, while small airlines (<2 million passengers/year) pay the lower sum.

  2. Rights to Services
    Waiting passengers with delays of over two hours should receive snacks and drinks. The airline must also provide the possibility to communicate (eg. through Wifi). If travelers suffer from an overnight delay, the airline must organize accommodation and transfer.
  3. Route Changes
    The airline must always find adequate replacement transportation, to assure that passengers arrive at their destination as soon as possible. If the disruption is over nine hours, passengers can even expect to be re-booked to a competing airline. Should it be impossible to find an adequate replacement, the passenger may ask for a reimbursement of the ticket costs. Depending on the reason for the flight disruption they can also request the compensation payments above.
